1. Introduction

These Terms of Service ("Terms") govern your use of the Somnara mobile application ("the App") operated by Somnara ("we", "us", or "our"). By accessing or using our App, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the App.

2. Eligibility

You must be at least 13 years old to use Somnara. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you must have your parent or guardian's permission to use the App.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

• Maintaining the confidentiality of your account and password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up-to-date

4. User Content

Our App allows you to post, link, store, share and otherwise make available certain information, text, or materials ("Content"). You retain ownership of your Content, but grant us the following:

• You retain all rights to your dream entries and personal content
• You grant Somnara a license to store, process, and display your content within the App
• AI-generated interpretations based on your dreams belong to you
• We may use anonymized, aggregated data to improve our services
• You are responsible for the content you create and share

5. Prohibited Uses

You agree not to use the App to:

• Violate any local, state, national, or international law
• Harass, abuse, or harm another person
• Impersonate any person or entity
• Upload or transmit viruses or malicious code
• Attempt to gain unauthorized access to the App or its systems
• Use automated systems or software to extract data from the App
• Interfere with or disrupt the App or servers
• Create multiple accounts for abusive purposes

6. Subscriptions and Billing

Somnara offers both free and premium subscription tiers:

• Free users receive 2 AI interpretations per week
• Premium subscriptions auto-renew unless cancelled
• You can cancel your subscription anytime through your app store account
• No refunds will be provided for partial subscription periods
• Premium features include unlimited interpretations, visualizations, analytics, and export options
• Prices may change with reasonable notice
• Free trials automatically convert to paid subscriptions unless cancelled

7. Disclaimers

Please understand that:

• Dream interpretations are for entertainment and self-reflection purposes only
• The App is not a substitute for professional medical or psychological advice
• We do not guarantee 100% availability of the service
• We are not responsible for any user-generated content
• The service is provided "as is" without warranties of any kind
• We reserve the right to modify or discontinue features at any time

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will cease immediately. You may delete your account at any time through the App settings. Upon account deletion, your data will be removed according to our Privacy Policy.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany and the European Union, without regard to its conflict of law provisions. Any disputes relating to these Terms will be resolved in the courts of Germany.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
